CanSpam Act Compliance:
Build Referrals Next Generation employs a strict NO SPAM policy. All signups at our site
used a verified double opt-in process which fully complies with the CanSpam Act 2003, so
you have real peace of mind. No one can sign you up without your knowledge. We utilize
verified, double optin techniques in the gathering of all leads and signups.
Spam Policy: We do not practice, participate in nor condone SPAM of any
sort. Offenders of SPAM will be notified in writing by us to cease and desist such
activities. Failure to comply will result in immediate termination of your membership
account without refund. The negligence of a single domain residing on our servers could
result in we being placed on an anti-spam list. Should we be placed on the anti-spam list,
all affiliate sites and domains will be affected and blocked. We wish to protect our
customers from this problem and for this reason, we will remain intolerant of SPAM.
Warranties Expresses and Implied:
Build Referrals, The Next Generation does not warrant that our Build Referrals, The Next
Generation website or service will be error free or uninterrupted. Our website and
services are delivered on an 'As Is' basis without warranties of any kind, either
expressed or implied. Build Referrals, The Next Generation, a division of JPE Advertising
and AEO Publishing Inc. will not be responsible for any losses, damages or costs that you
or your business may suffer when using our website or services.
You agree to indemnify and hold harmless, Build Referrals, The Next Generation, JPE
Advertising, and AEO Publishing Inc. from any claim resulting in your use of our Build
Referrals, The Next Generation website or services.
You expressly agree that your use of our Build Referrals, The Next Generation website and
service is at your sole risk. Neither Build Referrals, The Next Generation, JPE
Advertising, AEO Publishing Inc., or it's service providers, agents, licensors, employees,
or third party partners shall have any liability for any damages suffered by you or any
other party as a result of the use or misuse of our services.
Relationship Between You and Build Referrals, The Next Generation:
This is an agreement between independent contractors -- You and Build Referrals, The Next
Generation. This Agreement does not imply any partnership, joint venture, agency,
franchise, sales representative or employment relationship between you and Build
Referrals, The Next Generation. You will not have, nor will you represent that you have,
any authority to make or accept any offers or representations on our behalf. You will not
do anything to disparage or damage the reputation of Build Referrals, The Next Generation
any of its officers, employees, products and/or services.
Misrepresentation:
You will not misrepresent Build Referrals, The Next Generation by expressed or implied
claims of success, warranties or service obligations or there of on our behalf. We
disclaim any liability for such claims or implications made on your part to prospects,
potential customers, and/or customer of Build Referrals, The Next Generation. You
acknowledge this agreement will be terminated with or without notice for misrepresenting
Build Referrals, The Next Generation, its officers, employees, distributors, assigns or
products or services.
Modification of Terms & Conditions:
We may modify any of the terms and conditions of this Agreement, at any time and in our
sole discretion, by posting a change notice and the new agreement on our site.
Modifications may include but are not limited to changes in available fee or payment
schedules or procedures and Program rules. YOUR ONLY RECOURSE TO CHANGES UNACCEPTABLE TO
YOU IS TO TERMINATE THIS AGREEMENT. YOUR CONTINUED USE OF SERVICE(S) FOLLOWING THE POSTING
OF CHANGE ON OUR SITE WILL CONSTITUTE A BINDING ACCEPTANCE OF THE CHANGE.
Limitation of Liability:
We disclaim liability for any indirect, special or consequential damages, arising in
connection with this Agreement or Service(s), even if we have been advised of the
possibility of such damages.
Disclaimers:
We make no expressed or implied warranties or representations with respect to any services
purchased at Build Referrals, The Next Generation (including, without limitation,
warranties of fitness, merchantability, non-infringement or any implied warranties arising
out of a course of performance, dealing or trade usage). Further, we make no
representation that the operation of our network*, including our own Site, will be
uninterrupted or error free, and we will not be liable for the consequences of any
interruptions or errors.
Terms of this Agreement and Termination:
The duration of this Agreement will begin with our receipt of your sign up form which
expressly agrees to all the terms set forth on this website . You may terminate your paid
membership with Build Referrals, The Next Generation at any time by cancelling your
account with your payment processor. You may request a refund of your first month's
payment within the first 30 days of this agreement. Any payments made by you after the
first 30 days, will belong to Build Referrals, The Next Generation and will not be subject
to refund for any reason. It shall be your sole responsibility to cancel your membership
with your payment processor.
Build Referrals, The Next Generation retains the right to terminate your account at any
time without notice, if, in its sole discretion, you have violated the terms of this
agreement and no refunds shall be issued at the time of termination.
You understand and expressly agree that you will lose your website and access to your
membership area. Build Referrals, The Next Generation shall not be held liable for any
financial damages you may sustain as a result of your termination either voluntarily or by
the company.
Independent Investigation:
YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT AND AGREE TO ALL ITS TERMS AND
CONDITIONS. YOU HAVE INDEPENDENTLY EVALUATED THE DESIRABILITY OF PURCHASING Build
Referrals, The Next Generation SERVICE(S) AND ARE NOT RELYING ON ANY REPRESENTATION,
GUARANTEE OR STATEMENT OTHER THAN AS SET FORTH IN THIS AGREEMENT.
Miscellaneous:
This Agreement will be governed by the laws of the state of Michigan, without reference to
rules governing choice of laws. Our failure to enforce your strict performance of any
provision of this Agreement will not constitute a waiver of our right to subsequently
enforce such provision or any other provision of this Agreement Any action relating to
this Agreement must be brought in the federal or state courts located in the state of
Michigan and you irrevocably consent to the jurisdiction of such courts with your
acceptance of this Agreement. |
